WEDNESDAY, OCTOBER 2, 2013 – 6:00 P.M.
PUBLIC PARTICIPATION IS INVITED. Planning Commission meetings are held in the Town Council Chambers located at 14955 Dale Evans Parkway, Apple Valley, California. If you wish to be heard on any item on the agenda during the Commission’s consideration of that item, or earlier if determined by the Commission, please so indicate by filling out a "REQUEST TO SPEAK" form at the Commission meeting. Place the request in the Speaker Request Box on the table near the Secretary, or hand it to the Secretary at the Commission meeting. (G.C. 54954.3 {a}).
Materials related to an item on this agenda, submitted to the Commission after distribution of the agenda packet, are available for public inspection in the Town Clerk’s Office at 14955 Dale Evans Parkway, Apple Valley, CA during normal business hours. Such documents are also available on the Town of Apple Valley website at www.applevalley.org subject to staff’s ability to post the documents before the meeting.

APPROVAL OF MINUTES
1. Minutes for the Regular Meeting of September 18, 2013
PUBLIC HEARING ITEMS
2. Development Permit No. 2013-004 and Variance No. 2013-001. A request to approve a Development Permit to allow the construction of a 15,179 square foot, two (2)-story medical office building. The Variance is a request to allow a nine (9)-foot encroachment into the required front yard setback and an eleven (11)-foot encroachment into the required side yard (alley) setback. The project will include paved parking, lighting and landscaping.
Applicant: R.A.M. Architecture, representing Dr. Liu
Location: 16008 Kamana Road; APNs 0473-412-11 and -12.

Recommendation: Denial
3. Tentative Tract Map No. 18917. A request to subdivide approximately eighty-five (85) gross acres into 406 single-family residential lots within four (4) phases.
Applicant: Mr. Steve Ford for Pulte Homes
Location: The project is located within the Jess Ranch Planned Unit Development at the southwest corner of the termination of Town Center Drive and Jess Ranch Parkway; APNs 0399-261-03 and 0434-681-23.

4. Conditional Use Permit No. 2013-008. A request to approve a Conditional Use Permit to allow a trucking facility. The trucking company operates up to fifteen (15) trucks that will be parked on the property. The facility will not be open to the public for commercial truck parking. No changes are proposed to the two (2) existing structures.

Location: The project site is located at 13643 Tonikan Road (former animal shelter); APNs 3087-382-19, -20 & -21

5. Conditional Use Permit No. 2012-02, Amendment No 1. A request to review and amend previously approved Conditional Use Permit No. 2012-02 to allow an increase in height from seventy (70)-feet to eighty (80)-feet in height for a wireless telecommunication monopole designed as a pine tree.
Applicant: The Palmerin Group, Inc
Location: The project site is located on the Apple Valley Municipal Golf Course on Fairways #13 and #14; APN 3112-111-41.

6. Conditional Use Permit No. 2013-006 and Deviation Permit No. 2013-001. A request for approval of a Conditional Use Permit to construct a sixty-five (65)-foot tall wireless telecommunication facility designed as a clock tower within the Town’s complex of government buildings. The project includes a request for approval of a Deviation Permit to allow an encroachment of approximately 620 feet into the required 750-foot separation requirement between the wireless telecommunication facilities.

7. Development Code Amendment No. 2013-006 and Specific Plan No. 2005-001 Amendment No. 6. An Amendment to Title 9 "Development Code" of the Town of Apple Valley Municipal Code amending the development standards of photovoltaic solar farms within the Apple Valley Dry Lake area; and
An Amendment to the North Apple Valley Industrial Specific Plan (NAVISP) Section III “Development Standards and Guidelines” by amending the photovoltaic solar farms development standards.

8. Development Code Amendment No. 2013-005. A request to modify the provisions of the Development Code by amending various Sections within Chapter 9.74, "Signs and Advertising Displays".

9. A discussion pertaining to public hearing noticing requirements.
10. A discussion pertaining to a proposed Planning Commission Policy Statement that establishes criteria regarding requests to reduce the square footage and architectural modifications of previously approved Development Permit(s) for single-family tracts. The policy will be Town-wide for the remaining residential tracts that were not finished prior to the recent recession.
